Where are we with Pay Equity?
Last week, after discussions with Patricia Lowson our Barrister for the Pay Equity case, and with the ACTU and other unions, the ASU decided to write to FWA about the timetable for the case. Inspections, programmed for last week and this week are proceeding and going well.
During the inspections Justice Guidice indicated to Patricia informally his growing concern that the timetable set could not be met because of the delay in determining a government and that we would be unlikely to get the Commonwealth’s submissions by the due date of 16th September. We want to finish the case by the end of the year – this will be possible if the Full Bench has dates in November and December – Patricia is not hopeful of this and thinks it is more likely that the case will be postponed until February 2011. This is not ideal but we have little control over this.
Please note that the ACTU has written a letter in support of our request and we expect something from the government very soon – it may be that there is a further directions hearing. We will post that information on our website.
Patricia Lowson has also indicated that the inspections have thrown up more work for us to do. The national office may need some assistance from Branches. We will be in touch if we need to show support in any way. Please be prepared to assist your Pay Equity case.
